Cosby jury begins deliberations

But in closing statements Monday, the prosecution portrayed the actor as a sexual predator who deliberately drugged 44-year-old Canadian Andrea Constand so she could not resist his assault at his Philadelphia home in January 2004.

Cosby, 79, could serve 10 years in prison for the charges of three counts of aggravated indecent assault, making it possible the comedian and alumnus could be in prison for the rest of his life.

After four hours, the judge excused them for the night, with orders to resume deliberations at 9 a.m. Tuesday.

Since beginning deliberations on Monday afternoon, jurors have asked to hear some of Cosby's prior statements, including his description of the pills he gave Constand prior to the alleged attack.

If Cosby testifies, and denies drugging and molesting Constand or anyone else, the judge might allow more accusers to testify as rebuttal witnesses. She testified the pills left her semi-conscious and unable to tell Cosby to stop. He said it was up to the jury to determine what it means.

Cosby, the famed comedian, did not testify in his own defense, and his defense rested after calling just one repeat witness for further questioning. The prosecution was scheduled to give its closing after a lunch break.

The acting legend - famed for the long-running The Cosby Show - is accused of drugging and sexually assaulting university basketball coach Andrea Constand in 2004.

The brevity of the defense case contrasted with the presentation by prosecutors, who called 12 witnesses over five days of often emotional testimony.

"I want you to think about the courage Andrea Constand has had doing what she had to do", he urged the jury.

"Put them down, they're your friends".

What's the worst case scenario for Cosby?

Steele started dramatically, with the phrase "I have three friends to make you relax" displayed in all capital letters on a slide for jurors.

She became incapacitated and felt "frozen" and told him so, she testified. "She never said yes", he added. "I just wanted to go home". Why did he leave Constand alone on the couch without even a blanket, her clothes barely on her and disheveled? They cast him as an unfaithful husband - but not a criminal.

Constand's lawyer, Dolores Troiani, told reporters that Jackson is "not telling the truth" and faulted Wyatt for circulating Jackson's statement while jurors were deliberating. Cosby also faces up to $25,000 in fines if convicted, and would have to register as a sex offender.

He pointed out that Constand telephoned Cosby dozens of times after the alleged assault. Cosby had said before the trial he would not testify. "I'm insulted by that", Steele said. "It was a lot of confusion putting a lot of dates together".

During closing, McMonagle repeated to the jurors that Cosby's life is in their hands. He said the encounter occurred in 1990, while Johnson insists it was 1996. Yet to Cosby's defense team, the prosecution represents something else - a he-said, she-said where she says she was violated, and he says the encounter was mutually gratifying and romantic.

Cosby acknowledged that he obtained Quaaludes, a prescription sedative, in the 1970s to give to young women.

She sat across the aisle from Constand.

Some of these women, including Constand, have received cash payouts from Cosby in civil trials, but for numerous allegations the statute of limitations for criminal prosecution had lapsed. During the civil case, however, Bill Cosby gave sworn depositions that were later unsealed as part of the criminal case against him. His admissions in that deposition led Montgomery County prosecutors to file charges against him.

ALLYN: More than 50 women have accused Cosby of uninvited sexual advance, but nearly all of the cases were too old to prosecute.

The prominent Philadelphia defense attorney, who is seeking Cosby's full acquittal, said of Constand in his two-hour closing statement, "She said one thing yesterday, another thing today".

The media, including DW, do not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
