Cosby Rape Trial Goes To The Jury; Defense Called Only One Witness

Judge Steven O'Neill asked Cosby a series of questions created to make sure he was aware of his right to testify and wasn't pressured into deciding against it. Cosby spoke loudly as he answered, responding "YES!" or "NO!"

In the prosecution's closing argument, Steele said that Cosby's lurid statements from 2005 helped corroborate Constand's allegations.

Bill Cosby's lawyers rested their case after just a few minutes Monday without calling the comedian to the stand, opting against a high-stakes gamble that could have allowed him to work his charm on the jury but could have also exposed him to blistering cross-examination.

He said Constand was tailoring her story to fit a pre-ordained narrative and was continuing to do so even now, citing a detail from her testimony about the consumption of the pills that she had never mentioned before.

"Who says something like that?"

Though dozens of women have accused Cosby of sexual misconduct, Constand's accusations are the only ones that have led to criminal charges.

Cosby couldn't risk taking the stand and being cross-examined about the 60 other accusers if he denied ever drugging or molesting anyone. He said the encounter occurred in 1990, while Johnson insists it was 1996, the year she left her job. "Mrs. Cosby has been supporting Mr. Cosby for the entire time they've been together for 53 years", he said. She slipped into the courtroom while the judge was addressing the audience and the attorneys.

From her prime seat, Cosby's wife heard her husband's lawyer blame his legal woes on the supposed lies, greed and vanity of his accusers.

"Constand, 44, testified. that Cosby gave her three blue pills and then penetrated her with [his] fingers against her will as she lay paralyzed and half-conscious". Cosby had said before the trial he would not testify.

Prosecutors suggest Cosby gave her something stronger. And he grew emotional when speaking about Constand, and accused Cosby's lawyers of attempting to shame and exploit her.

As expected, Cosby did not testify and when the judge asked him if that was his choice, he responded in a loud voice: "Correct!" Cosby raised his hand when the judge said he couldn't see the entertainer.

"One of the greatest storytellers in the world and I'm failing", Cosby said when asked to repeat an answer in the deposition.

"This ain't right!" bellowed McMonagle.

Constand initially settled the case with a civil suit in 2006, having waited a year to report the alleged assault to the police.

"That's a lie", McMonagle told jurors. The implication is that she was after money from Cosby, one of America's wealthier stars. "We're talking about all of a man's tomorrows".

Defense attorney Brian McMonagle told the jury that the two were lovers who had enjoyed secret "romantic interludes" and that the 2004 encounter was consensual. "It's criminal", the district attorney Kevin Steele said.

Prosecutors are poised to give their closing argument Monday afternoon.

The second call is evidence of consciousness of guilt, Steele argued, as was the suggestion by Cosby and a team of lawyers to send Andrea and Gianna Constand to Miami, Florida, to meet with Cosby and discuss the situation.

Constand - who at the time of the assault was the director of women's basketball at Temple University, where the actor sat on the board of trustees - testified last week that the assault left her humiliated by someone she had thought of as a friend and mentor.

As they watched, Steele repeatedly asserted that, in a sense, Cosby had already confessed.

Unsealed in 2015, the testimony contains statements from Cosby admitting to giving quaaludes - a sleep aid that became a popular party drug - to women in the 1970s when he wanted to have sex with them.

"But under the defendant's own words, you must convict". "They'll take the edge off", Cosby told her, she testified. A prosecution expert testified that such assertions amounted to "rape myths". "We're not here because of Andrea Constand", he said.

The fast-moving case went to the jury of seven men and five women on day six of the trial after closing arguments gave differing portrayals of what happened between Cosby and Andrea Constand at his suburban Philadelphia estate.
