Cosby's team attacks judge likely to retry him in sex case

Constand, now 44, initially went to police about a year after she said Cosby assaulted her, but a prosecutor declared her case too weak to bring charges.

Prosecutors had sought to have 13 other accusers testify in Constand's case, but the judge allowed only one, finding that more would unfairly prejudice the jury. As news reporters streamed out of the room, several other Cosby accusers, some in tears, waited in line to hug Constand, who smiled broadly and maintained her composure.

But Cosby's reputation remains in tatters, following a slew of sexual assault allegations from about 60 women that have destroyed the "America's dad" image he built as star of the long-running 1980s TV comedy "The Cosby Show".

Callan said the $33.5 million awarded in the case reflected the jury's reaction to a double homicide and was larger than a potential award to someone who has civil claims against Cosby.

Publicist Andrew Wyatt raised a clenched fist as he led the legally blind Cosby out of the courthouse after the jury deadlocked Saturday, while cameras popped and his lead defense lawyer walked away.

The entertainer's wife of 53 years, Camille, slammed prosecutors for bringing the case to court, calling Steele "heinously and exploitively ambitious" in a statement released after the trial.

"How do I describe the district attorney?" Overtly and arrogantly collaborating with the District Attorney.

"How do I describe the counsels for the accusers?"

The comedian also faces a defamation lawsuit by model Janice Dickinson, who claims Cosby drugged and raped her in Lake Tahoe, California, in 1982. "You're not off the hook, buddy", she said outside the courtroom.

"She's a very spiritual woman, she believes things happen for a goal, and I think the objective is.it should encourage other women to come forward and have their day in court". Cosby has denied all of the accusations.

At least 10 women have pending civil claims against Cosby in lawsuits filed in California and MA.

McMonagle said it was up to Cosby whether he would represent him in court again.

He co-starred in the 1960s espionage show "I Spy", the first black performer to star in a weekly American TV dramatic series. At the time, Constand worked at Cosby's alma mater, Temple University. "Do they want to save Cosby, or do what the first jury couldn't do, which was convict him?" Cosby's trial ended without a verdict.

"It can never be clearer that if you speak up, you could be chilling the justice system in the future if jurors are needed in this case", O'Neill told them. Judge Steven O'Neill could revisit the issue as early as Monday.

In civil lawsuits in the United States, plaintiffs need only show that the weight of evidence is on their side, meaning they have information to tip the scales above 50% in their favor, as opposed to criminal cases in which prosecutors must prove claims beyond a reasonable doubt. In 2005, prosecutors declined to charge Cosby based on Constand's account, and she filed a lawsuit that Cosby settled for an undisclosed sum. Cosby pleaded not guilty to the charges.

His depositions in that case, however, were unsealed by a federal judge in 2015, revealing his admissions that he had given sedatives to young women in the 1970s and prompting prosecutors to reopen the case.

Although the district attorney has vowed to try the case again, Steele may have difficulty in winning an eventual conviction, according to former prosecutors and defense lawyers.

Cosby's team declared victory, however temporary.
