McGovern: Judge's ruling finds Michelle Carter's words killed Conrad Roy

Judge Moniz agreed with the prosecution, saying today that "Ms. Carter's actions, and also her failure to act, where she had a self-created duty to Mr. Roy, since she had put him into that toxic environment, constituted, each and all, wanton and reckless conduct".

Carter did that despite knowing "all of the feelings" Roy had shared with her previously, including a prior attempt to drown himself, Mr Moniz said.

Moniz said Carter's initial text messages pressuring Roy to kill himself were not enough to find her guilty. Records show a lengthy text message history between Roy and his girlfriend Michelle Carter, in which Carter repeatedly urges him to commit suicide. In a particularly disturbing exchange in the weeks before his death, Carter told Roy, "It's time". At one point, Roy told Carter that he felt fearful and had gotten out of the truck. She could face up to 20 years in prison, although Moniz noted he considered her a "youthful offender".

She sent Roy a barrage of text messages urging him to kill himself leading up to his suicide.

She is scheduled to be sentenced August 3rd. Instead, the court upheld the indictment for involuntary manslaughter on "the basis of words alone" and that Carter was "virtually present" at Roy's suicide.

Meanwhile, some believe the guilty verdict in Carter's involuntary manslaughter trial might be grounds to expand the territories under manslaughter law.

Another update in the devastating Michelle Carter case.

Local attorney Kevin Reddington, who was in the courtroom when the judge read his verdict, said the judge gave a "very well reasoned decision that is consistent with the law".

Matthew Segal, a lawyer with the American Civil Liberties Union of MA, said that the verdict was a "drastic expansion of criminal law in MA". He pointed out that Roy had stepped out of the truck, and told Carter he couldn't go through with it. "You just need to do it like you did last time and not think about it and just do it babe".

"She did not issue a simple additional instruction: Get out of the truck", the judge said. The trial marked the first time that prosecutors in the state have sought such a stiff charge in a case based on text messages. As jury selection was set to begin, Carter waived her right to a trial by jury, according to CBS Boston.

The northeastern state of MA, unlike other USA states, has no law against encouraging someone to commit suicide.
