Supreme Court to rule on wedding cake case pitting religion aga

The Colorado Court of appeals upheld the commission's decision.

In the current case, two men filed a complaint against Jack Phillips of Masterpiece Cakeshop in suburban Denver after he refused to make a cake for their wedding reception. The couple filed a civil rights complaint, arguing that Phillips discriminated against them due to their sexual orientation. The state law now states that businesses open to the public may not deny service to customers based on their race, religion, sex or sexual orientation.

Is it more important to protect a business owner's religious beliefs or to protect the idea that any customers who show up should be treated equally - regardless of their sexual orientation? Vice President Mike Pence signed one of these laws while he was governor of Indiana.

Justice Sonia Sotomayor dissented, arguing that the court's reasoning "weakens this country's longstanding commitment to a separation of church and state beneficial to both".

In 2015, an appeals court in Colorado rejected Phillips' stance, saying that requiring someone to comply with the law is not the same as compelling them to "endorse" something they don't agree with. "Artists speak through their art, and when Jack creates custom wedding cakes, he is promoting and celebrating the couple's wedding", said ADF Senior Counsel Jeremy Tedesco. "Businesses should not be allowed to violate the law and discriminate against us because of who we are and who we love".

Hoping to overturn the commission's findings, Masterpiece Cakeshop tried to distinguish the opposition of same-sex marriage from discriminating against sexual orientation. That solution would've been eminently sensible since the court has never held that commercial businesses have a constitutional right to discriminate against a certain class of customers.

The five justices who sided with the plaintiffs ruled that Arkansas' law was in violation of the court's 2015 decision in Obergefell v. Hodges, that made same-sex marriage law of the land.

Justices will hear arguments in the case in the Court's next term, which begins in October.

The Colorado case will represent a telling look at newly confirmed U.S. Supreme Court Justices Neil Gorsuch. On Monday, after the revelry had quieted and everyone had returned to work, news broke of a new fight in the battle against anti-gay discrimination, or, conversely, the right to religious freedom.

"The ruling that the banker wants would decimate our civil rights laws, not just for LGBT people but for all people protected by our nondiscrimination laws".

In a similar PRRI poll, majorities of every major religious tradition, including white evangelicals, said they did not believe small business owners should be allowed to "refuse services to gay and lesbian people".
