Trump tweet appears to confirm he's under investigation

He has also started to direct some of his anger at Deputy Attorney General Rod Rosenstein, who oversees special counsel Robert Mueller's Russian Federation probe, according to the AP and the New York Times. "However, nothing has changed", DOJ spokesman Ian Prior said in a statement, according to the Washington Post.

Sources told ABC that Rosenstein told Associate Attorney General Rachel Brand that she would have to assume those responsibilities if he recused himself.

Although Rosenstein appointed a special counsel to lead the federal probe, he still makes the final decisions about resources, personnel and - if necessary - any prosecutions.

The president tweeted that he was being investigated by the person who recommended the firing of FBI Director James Comey, citing a memo Rosenstein drafted for his recommendation to Trump.

Reports that Trump allegedly asked two intelligence chiefs to publicly deny any cooperation between his campaign and Russian Federation are also said to be part of the investigation. Sad!" he wrote. "Despite the phony Witch Hunt going on in America, the economic & jobs numbers are great.

"Nearly everyone agrees that the Director made serious mistakes; it is one of the few issues that unites people of diverse perspectives", Rosenstein said in his memo.

Trump has repeatedly expressed his frustration with the special counsel investigation, calling it a "witch hunt", but he can't directly fire Mueller.

Stepping back, though, it's hard not to notice that the president is generally at his most satisfied when he's attacking a foe: Hillary Clinton, news organizations and journalists, Democrats, U.S. allies who've bothered him in some way, etc. Trump seems to operate from the assumption that if you're not hitting someone, then someone is hitting you, so it's best to remain on the offensive at all times. If Trump fired Rosenstein, Brand might resign because she and Rosenstein were nominated together, have a close working relationship and went through their confirmation hearings as a team.

Richard Painter, who served as President George W. Bush's chief ethics lawyer from 2005 to 2007, told The News it wasn't a slam-dunk that Trump's latest tweet would help the building of potential obstruction justice case against Trump - but he said it definitely wouldn't help Trump either. But last night Rosenstein issued this rather unusual statement saying Americans should be skeptical about news accounts of an investigation that are based on anonymous allegations.

A Trump confidant said this week the president had considered firing Mueller. Comey testified that Trump directed him in February to drop an FBI investigation into former national security adviser Michael Flynn relating to the Russian Federation matter. Mueller may want to learn about Trump's conversations with Rosenstein, the Justice Department official who wrote the memo criticizing Comey's performance before his firing on May 9.

Investigators in Mueller's office are set to interview Director of National Intelligence Dan Coats and National Security Agency Director Adm. Mike Rogers, a source familiar with the matter has told CNN. If Trump begins firing such people and the GOP's political position keeps eroding-pay attention to the special election in Georgia on Tuesday-maybe more Republicans will start to wonder if it's time for President Pence.

There is also no rule barring such donations, said David Alan Sklansky, a criminal procedure professor at Stanford University. Brand, 44, would only gain that authority if Rosenstein recused himself, but that is becoming a real possibility.
