Trump tweet appears to confirm investigation

Sen. Richard Burr, R-N.C., right, chairman of the Senate Select Committee on Intelligence, and Vice Chairman Mark Warner, D-Va., left, listen as Attorney General Jeff Sessions testifies before the Senate Select Committee on Intelligence about his role in the firing of FBI Director James Comey and the investigation into contacts between Trump campaign associates and Russian Federation, on Capitol Hill in Washington, Tuesday, June 13, 2017.

The former US attorney for Maryland is understood to have played a key role in President Donald Trump's dismissal of former Federal Bureau of Investigation director James Comey, with the White House citing a memo in which Rosenstein raised concerns over Comey's performance. Rosenstein had written a scathing memo criticizing Comey's handling of the Hillary Clinton email investigation, which the White House initially cited as the impetus for Comey's ouster.

'And in fact when I chose to just do it, I said to myself, I said, "You know, this Russian Federation thing with Trump and Russian Federation is a made-up story, it's an excuse by the Democrats for having lost an election that they should have won,"' Trump said at the time.

A career prosecutor who entered the administration with a reputation as a meticulous, nonpartisan lawyer, Rosenstein has been buffeted in his short time on the job by political storms - and now the extraordinary spectacle of being singled out on social media by the president.

The Hill reports that the new team members are highly qualified. He lashed out at a top Justice Department official overseeing the inquiry, reflecting his mounting frustration with the unrelenting controversy that has consumed his early presidency.

If Rosenstein goes, who replaces him?

Mr Comey told Congress last week that before being sacked, Mr Trump pressured him to drop an investigation into his former national security adviser, Mike Flynn, who was forced to quit for lying about his links to Moscow.

Will Rosenstein recuse himself from overseeing...

Was the Rosenstein memo the reason Comey was sacked?

Hours later, a source close to Trump's outside legal team said Trump did not intend his tweet to be confirmation of the investigation but rather was reacting to a Washington Post story on Wednesday about the probe.

But according to Jack Goldsmith and Benjamin Wittes at Lawfare, Mueller has the real power in the investigation.

Brand was very recently confirmed as the No. 3 person in the Department of Justice - she's been acting as the associate attorney general for less than a month.

The Russia investigation has already put the Justice Department in an unusual position. That falls to Deputy Attorney General Rosenstein, who was asked this by Republican senator from Maine Susan Collins at a hearing on Tuesday.

Brand, 44, would only gain that authority if Rosenstein recused himself, but that is becoming a real possibility.

After Boente, the responsibility would fall to the USA attorney for the Eastern District of North Carolina and then the US attorney for the Northern District of Texas. Someone else would have to fill that role.

Mr Rosenstein has said privately he may need to recuse himself from matters relating to the Russian Federation probe because he could become a witness in the investigation, ABC News reported on Friday. Trump said on Twitter.

There is also no rule barring such donations, said David Alan Sklansky, a criminal procedure professor at Stanford University.

Among its other points, the memo also orders that any records be preserved about foreign travel by transition officials or personnel of Trump's presidential campaign.

"He's in for a rude awakening" if he thinks he can shut down the investigation that way, said Feinstein. In keeping with a new practice, she referred one question after another to Mr Trump's personal lawyer. "There is too much cross-pollination between his background and that of James Comey".

Mr Trump took to Twitter yesterday to insist that despite months of investigating, no evidence has emerged that he colluded with Russian Federation to tilt the presidential election a year ago in his favour.
