Final hearing on Ram Janmabhoomi-Babri Masjid dispute will start December 5

Final hearing on Ram Janmabhoomi-Babri Masjid dispute will start December 5

The Allahabad high court had ruled a three-way division of the disputed 2.77 acre-site between the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla in 2010.

A day after taking a stand that it was agreeable to shifting of the demolished mosque to bring about a closure to the vexed dispute, the board chose to revive its dispute with the Sunni Waqf Board by filing an appeal after more than seven decades.

The Supreme Court will hear the petitions in the historical Babri Masjid-Ram Janmabhoomi land dispute case on Friday.

One such scene was created when Advocate MC Dhingra Rose to speak on behalf of the Shia Central Waqf Board which has sought to replace the Sunni Central Waqf Board as a party to the case. There is no locus standi to it. The Bench pointed out that these are the same documents which had already been produced before the Allahabad High Court.

The Hindus claim that it is the birthplace of Lord Rama where a mosque was built in 1528-29 CE (935 AH) by Mir Baqi. Hence the mutawali or caretaker is the Shia Waqf Board. During the entire hearing before the High Court, the Shia board never took any such stance and hence it does will not stand before the SC, Jilani also said. This was done through an affidavit that was filed stating that a mosque could be built at near the temple. Babur stayed near Ayodhya only for 5-6 days whereas construction of mosque took more time (demolition of temple and building of mosque). "And halted here only for a week and it was during his regime the Janmasthan temple was destroyed and on its site a mosque was built using largely the materials of the old structure". "The reason being, even if mosque is built in the one-third area, it will not bring a permanent solution between the two religious denominations", he said. The trial court failed to appreciate that merely ordering to build mosque does not make that person as Wakif. However it was the British government which erroneously included it amongst the Sunni Waqfs in 1944 and it had approached Faizabad civil court in 1945 which had dismissed its claim a year after. "So let's start and the translations can be done as and when a document is relied on during the hearing", Mr. Mehta submitted.
