Lalu moves court, seeks minimum sentence in fodder scam citing poor health

Ranchi: The CBI court will pronounce on Saturday the quantum of punishment against RJD supremo Lalu Prasad and 10 others in a fodder scam case, his counsel said today.

Lalu Yadav mentioned in his plea, "I have no role in this scam directly; consider minimum punishment keeping in view my age and health grounds", as per reports.

He also submitted that his client was pronounced five-year jail term in fodder scam case RC20A/96 amounting to Rs 31 crore, while RC64A/96 amounts to just Rs 79 lakh, hence punished sentence may be pronounced accordingly.

ANI reported that the quantum of sentence was not announced today due to the death of advocate Vindeshwari Prasad.

Lalu's lawyer on Friday pleaded for leniency to the former chief minister of Bihar, arguing that the RJD chief was not in good health after his valve replacement at a prominent hospital in Mumbai.

Lalu Prasad's lawyer on Tuesday told reporters that they would press for minimum punishment in the case.

"I do not know about the court's summon...when I'll receive it, I will reply to it", said Raghuvansh Prasad Singh who was present at the court premises.

In his application, Lalu Prasad said that the Birsa Munda jail did not have clean drinking water and this may affect his kidneys. "Then why don't you do a 2-3 month course in jail so that you continue to inspire other prisoners", the judge shot back, in a lighter vein.

The 15 accused in the case, including Lalu, have been convicted for offences of cheating with criminal conspiracy under the Indian Penal Code and the Prevention of Corruption Act.

In 1996, the Patna High Court had ordered an inquiry into the fodder scam cases and a charge sheet in the Deogarh treasury case was filed against 38 people on 27 October, 1997.

Rashtriya Janata Dal (RJD) spokesperson Manoj Jha on Wendesday denied committing contempt of court.

Earlier, he was awarded five years imprisonment in 2013 in a case relating to fraudulent withdrawal of Rs 33.61 crore from the Chaibasa treasury. After the conviction of lalu Prasad Yadav in the fodder scam case on December 23. If he gets three years' punishment, he would get bail soon after sentencing.
