Lok Sabha passes Bill that criminalises triple talaq

Lok Sabha passes Bill that criminalises triple talaq

Nonetheless, the whole idea of criminalizing triple talaq, despite the fact that the country's apex court had struck down the tradition, seems rather very odd.

Zakia Soman, a women's rights activist, and founder of women's group, The Bharatiya Muslim Mahila Andola, said that the law is much needed by women in the Muslim community who had long suffered legal discrimination.

There is also a view in the Congress that the party should press for making the offence by husband bailable even if the penal provisions were not diluted or done away with.

The government's determination to get the Bill passed could be gauged from the fact that it was introduced in the morning and taken up for consideration in the afternoon by suspending relevant rules and then passed in the evening by sitting late beyond the scheduled close of the House.

DMK Working President MK Stalin also objected to the "stringent" three-year jail term for men and wanted to know if the BJP government at the Centre was really concerned about the welfare of Muslim women. CPI (M) leader Karat said the bill "itself is very objectionable, and equally objectionable are the efforts of BJP to push it through Parliament without any consultation or discussion with those in whose names the bill is been passed". This year in August, After hearing on the Shayara Bano case and several petitions against Triple Talaq, Supreme Court summarised Triple Talaq as unconstitutional. The Congress will support any and every law abolishing instant triple talaq. Talking to PTI she said, "I welcome the move, but now men will take undue advantage of the law and indulge in polygamy openly as it is still in practice". BJP Spokesperson GVL Narasimha Rao tweeted, "To Appeasers' Alliance comprising Owaisi, RahulG, Mamata; Mulayam, Lalu: Stop communal politics!" Triple talaq is a crime and has spoilt many lives. Farah was one among the three - Rizwana and Razia - who fought for the ban of triple talaq.

The belief will persist, therefore, that it is a desire to "garner votes" which is behind the decision, notwithstanding Law Minister Ravi Shankar Prasad's disavowal of such an intention. Certainly there had been demand for an enactment and a law to strengthen Muslim Women's rights.

The government is keen for the Bill's passage in the ongoing Winter Session which has only four working days left.
